The complainant alleges that the police resorted to this arrest because Anna Hazare raised his voice against corruption and vowed to protest for an effective Lokpal Bill through peaceful assembly. It is alleged in the complaint that this act is in contravention to the laid down laws and established international human rights principles. The complainant has prayed for intervention of the Commission in the matter. The incident has also been widely reported in the media. The contents of the complaint, if true, raises a serious issue of violation of human rights. Issue NOTICE to Secretary, MHA, GOI and Commissioner of Police, Delhi to submit a detailed report in the matter within two weeks.

Direction issued by the Commission"The complainant in his complaint dated 20.03.2007 alleged the torture of family members of Latifur Rahman Sarkar by personnel of 72nd Battalion Border Security Force at Dudapur village under Kumarganj Police Station in South Dinajpur District of West Bengal on 04.03.2007 which resulted in the death of Latifur's son Mausad Rana Sarkar(19) on 05.03.2007. It is alleged that on 04.03.2007 a group of 15-20 BSF personnel, who were drunk, raided the house of Latifur Rahman at Daudur village and beat up and tortured family members without any cause. Four members of the family were admitted to the hospital with injuries on 05.03.2007. The son of Latifur Rahman along with Latifur was shifted to North Bengal Medical College where Masud died in the night of 05.03.2007. The Commission vide its proceedings dated 26.11.2009 recommended to pay a sum of Rs. 5 Lakhs to the next of kin of the deceased and Rs. 50,000/- each to the injured persons. Pursuant to the communications of the Commission, Under Secretary, Ministry of Home Affairs, Govt. of India vide his letter dated 09.06.2011 informed that the recommended amount has been sanctioned by the government. DIG (OPS) C, Ministry of Home Affairs, Govt. of India has informed vide letter dated 15.07.2011 that an amount of Rs. 5 Lakh has been paid to Latifur Rahman Sarkar, NOK of Late Masud Rana Sarkar and an amount of Rs. 50,000/- each to Latifur Rahman Sarkar, Mazeda Bibi and Fensiyara Begam. A copy of each of the proof of payment has also been claimed to be enclosed with the letter, but the Commission received only copy of proof of payment of Rs. 5 Lakh paid to Latifur Rahman Sarkar. However, the Commission assumes that the recommended amount has been paid to the payees and therefore closes the file. Direction issued by the CommissionThe Commission took cognizance of an article written by People's Union for Civil Liberties under the captioned "Dantewada rapes" dated 2.7.2010. The article alleged several incidents of rape of women and picking up of five people by the forces. But, it did not mention the details and the dates of the incidents. The Commission took cognizance of the article on 22.7.2010 and issued notices to the Secretary, Ministry of Home Affairs, Government of India, New Delhi, the Chief Secretary, Government of Chhattisgarh, Raipur and the Director General of Police, Government of Chhattisgarh, Raipur for seeking reports in the matter. Pursuant to the aforesaid directions, a report dated 28.9.2010 has been received from the Directorate General, CRPF, C.G.O. complex, Lodhi Road, New Delhi. The report has denied all the allegations made in the complaint. It inter-alia mentions as under:- "The investigation report shows that, the allegations levelled against the CRPF by the People's Union for Civil Liberties (PUCL) are baseless and fabricated. It appears that, in order to discourage the Security Forces from carrying out special operations against the Naxalites, such type of allegations are being made by PUCL. Our investigation shows that, no CRPF personnel of Chintalnar camp had gone in civvies to PUCL officials as local guide. If the PUCL or anybody had any complaint of rape of ten women or even a single woman. FIR should have been registered in the local police station. Since, no FIR or complaint has been lodged with the local police by any one against CRPF, the allegation appears to be concocted. The village of Mukram is only a few kilometers away from the place where Maoists ambushed 76 Security personnel in April 2010. The allegation of rape of three girls on May 22 is also completely false. Neither five people including the Sarpanch were picked up from village nor any house Mangal Kunjam was broken. The version of 115 families moving out to AP does not seem to be true either. The truth is that after the ambush of CRPF where CRPF by the naxals, wherein CRPF suffered heavy losses, our troops were under shock that they did not move out at all for some time. Therefore, we had to send additional reinforcement to improve the morale and security of the camp. Thus, the allegations made by Tusha@Tehlka.com against CRPF personnel in the complaint made to NHRC are far from truth." Reports have also been received from the Deputy Inspector General of Police, Raipur and the Under Secretary, Home (Police) Department, Chhattisgarh Administration, Raipur. In their reports dated 28.9.2010 and 2.12.2010, the allegations made in the article have been denied. The matter relates to alleged atrocities by CRPF personnel. Hence, it may be placed before the Division Bench.
